Yoklama kaçağı, saklı ve bakayalar Askeralma Kanununun 24’üncü maddesinin birinci fıkrası esaslarına göre idari para cezasıyla cezalandırılır. 2. Bunlardan kendiliğinden gelenler her gün karşılığı 5 Türk Lirası, yakalananlar ise 10 Türk Lirası idari para cezası ile cezalandırılır. Bu fıkra kapsamında belirlenen idari para cezalarının yeniden değerlemesinde 30/3/2005 tarihli ve 5326 sayılı Kabahatler Kanununun 17’nci maddesinin yedinci fıkrasındaki idari para cezasının bir Türk Lirasının küsuru dikkate alınarak uygulanır. İdari para cezaları tebliğinden itibaren bir ay içinde ödenir. 3. Yapılan muayenelerinde askerliğe elverişli olmadıkları anlaşılanlar, askerlikten muafiyet hakkı olanlar ile Kanunda belirtilen nedenlerle erteleme hakkı olduğu halde süresi içerisinde işlem yaptırmayanlara erteleme sürelerine denk gelen günler için idari para cezası uygulanmaz. Uygulandıktan sonra bu madde kapsamında olduğu anlaşılanlar iptal edilir ve iptal edilen para cezaları, 21/7/1953 tarihli ve 6183 sayılı Amme Alacaklarının Tahsil Usulü Hakkında Kanun kapsamında takip ve tahsil için gönderildiği vergi dairelerine bildirilir. Askeralma Yönetmeliğinin 54’üncü maddenin üçüncü fıkrası kapsamında ertelemesi yapılanların, yoklama kaçağı veya bakaya olarak geçen süreleri için Askeralma Kanununun 24’üncü maddesi esasları uygulanır. 4. İdari para cezası vermeye yetkili makam; askerlik şubesine bizzat müracaat eden yükümlüler için müracaat ettiği, kolluk kuvvetleri tarafından getirilen yükümlüler için ise getirildiği askerlik şubesi başkanı; kolluk kuvvetleri tarafından haklarında tutanak tutulma işlemi de dâhil diğer durumlar için nüfusa kayıtlı olduğu yer askerlik şubesi başkanıdır. Yükümlünün bizzat müracaat ettiği veya getirildiği askerlik şubesi başkanınca uygulanan idari para cezası derhâl yükümlünün nüfusa kayıtlı olduğu yer askerlik şubesi başkanlığına bildirilir. 5. Barışta, Askeralma Kanununun 24’üncü maddesinin birinci fıkrası uyarınca verilen idarî para cezası kesinleştikten sonra bu eylemlerden herhangi birini işleyenler ile bu eylemleri seferberlik ve savaş hâlinde işleyenler hakkında nüfusa kayıtlı olduğu yer askerlik şubesince suç dosyaları hazırlanarak yükümlünün nüfusa kayıtlı oldukları yer Cumhuriyet başsavcılığına gönderilir. 6. Yükümlülere verilen idari para cezaları 7201 sayılı Kanun ile 25/1/2012 tarihli ve 28184 sayılı Resmî Gazete’de yayımlanan Tebligat Kanununun Uygulanmasına Dair Yönetmelik esaslarına göre tebliğ edilir. 7. Verilen idari para cezaları hakkında 5326 sayılı Kanun hükümleri uygulanır.
